New Delhi (05.09.2024): The introduction of 360-degree method for empanelment has left bureaucrats clueless about the fact that why and how he/she missed the opportunity to get empanelled as Joint Secretary, Additional Secretary or Secretary in the Government of India. But a new judgement of a bench headed by the Uttarakhand High Court Chief Justice has given them a sigh of relief and some hope. Probably, the aggrieved officers may now have the right to claim to have the record relating to the process and decision-making of empanelment.
The order uploaded on the Uttarakhand HC website last night enabled Sanjeev Chaturvedi (IFS: 2002: UD) to have the government records pertaining to his evaluation and empanelment as Joint Secretary. The said decision underscores, “It is being clarified that only the records relating to the petitioner’s empanelment shall be supplied to the petitioner.” 
Reportedly, the HC Bench, while passing the order, was clear that Chaturvedi did not challenge the decision of the expert committee i.e. CSB and ACC but claimed his fundamental rights i.e. right to express and know. 
A section of bureaucrats considers this as a landmark decision like the 2007 Supreme Court judgement in Dev Dutt vs. UOI. It may be underlined that the decision would work for others as a precedence and can be utilised by all those who want to access their empanelment records.
