Bengaluru (27.09.2024):Karnataka Cabinet has withdrawn its consent from the CBI to conduct enquiry into the territory of the state. Since the CBI is governed by The Delhi Special Police Establishment (DSPE) Act, 1946 which requires consent of the state government concerned before starting any investigation of a crime in the state. The consent of the state government can be either case-specific or general.
Cabinet has withdrawn the notification to conduct an open investigation in the state of Karnataka. Karnataka Law and Parliamentary Minister H K Patil clarified that if the court orders a CBI investigation, the CBI probe restraining order taken by the government will not be applicable. It was alleged that the permission was held back for alleged misuse of the CBI against opposition parties and governments.
