ed-investigation-in-aircel-maxis-deal-exposes-deeds-of-chidambaramThe Enforcement Directorate (ED) has found in the course of its investigation that though the Aircel-Maxis deal involved an FDI of USD 800 Million (over Rs. 3500 crores) and whose clearance was only within the competence of the Cabinet Committee on Economic Affairs (CCEA), the proposal was wrongly projected as an investment of Rs. 180 crore so that it need not be sent to CCEA to avoid detailed scrutiny by the CCEA. The FDI included indirect investment by way of trust issue of preference shares of USD 375 Milion (over Rs. 1650 crore) and this fact was concealed. ED's investigations have also shown that a payment of Rs. 26 lakh by Aircel Televentures Limited (ATVL) (the seller of equity shares in this deal) was made to Karti Chidambaram's Advantage Strategic Consulting Pvt. Ltd. (ASCPL) within a few days of the FIPB approval. Investigations have also revealed that CMSPL (a company promoted by Karti Chidambaram) and A. Palaniappan (nephew of P. Chidambaram) received a sum of USD 2 lakh approx. from Maxis Group company allegedly for a legal compliance software. However, the software became operational only at a much later date (long after payments were received from Maxis Group companies). The investigation further revealed that the software was designed only for use in India i.e. with reference to various laws applicable in India and hence was of no use to a Malaysian company in Malaysia. Investigations have established that Advantage Strategic Consulting Pvt. Ltd. (ASCPL) was controlled by Karti P. Chidambaram, the son of the Finance Minister (FM), who gave irregular FIPB approval bypassing CCEA. The investigation further revealed that Karti Chidambaram controlled ASCPL through one S. Bhaskararaman who is described as Karti P. Chidambaram, CFO / CA likely after financial matters of Karti P. Chidambaram. The main shareholders of ASCPL are Ms. V. Padma (wife of S. Bhaskararaman), Ravi Visvanathan (brother of Ms. Padma) and CBN Reddy. The investigation further showed that ASCPL and foreign subsidiary received payments for other issues and approvals granted by Finance Ministry (for example 2% of the amount released by SBI consortium), payment for FIPB approvals etc. One such issue was of INX Media in which CBI & ED have registered cases under P.C.
