Recently, the Centre showed its will and intent to fill up the vacancies in nine HCs and sent the files of 69 recommendations to the SC collegium. Despite this, there is no end in sight of tussle between executive and judiciary in the country. Many a times such differences emanate from the difference of opinion and approach of the two. In the fresh incident of battle of one-upmanship, the Centre has returned to the Supreme Court collegium yet another recommendation for appointment of Calcutta High Court Judge Justice Aniruddha Bose as the Chief Justice of the Delhi High Court. Reason given by the Centre for returning the collegium's recommendation is that the Delhi High Court is a premier High Court that has handled important and complicated questions of law and that the court has always been headed by a seasoned judge, even Chief Justice of another High Court. In the background of the fact that the Centre has stoutly rejected the appointment of Uttarakhand Chief Justice K M Joseph as the apex court judge, the recent move by the Law Ministry on Justice Bose's appointment is likely to further muddy relations between the two sides, feel experts.
