Extra-marital affair not a ground for suspension; Sacked IPS officer may make a comeback?

Former Rajasthan cadre IPS officer Pankaj Chaudhary (2009 batch), who was dismissed earlier this month from the service for an alleged extra-marital affair is expected to make a comeback in the backdrop of a Rajasthan High Court order issued on Friday.

While hearing petition the single-judge HC Bench ruled that extra-marital affairs can't be the ground for the action of suspension against a government official. The petition was filed by two police officials who were suspended in March 2001 for alleged extra-marital affairs.

The case is similar to that of Chaudhary who was terminated on the grounds of marrying the second time without getting a divorce from the first wife.

Speaking to IANS, Chaudhary said: "This case has come as a breather for me as it shares the same grounds as mine. In fact, there are many such cases where the court has pronounced similar orders. Therefore, I am fighting my case with full confidence.

"My case doesn't violate either the Indian Penal Code or any other civil laws. On May 1, 2018, I was granted a divorce and on July 14, 2018, I entered into wedlock for the second time in Varanasi following all government norms. But the previous government kept this report hidden and forwarded my matter to the higher authorities." 

Chaudhary said: "In February 2016, the government called a press conference and in April issued a charge sheet. When they appointed an investigating officer, I wrote to the government that the IO should be trustworthy.

The IAS officer appointed as the IO had been suspended several times in seven cases of corruption and was under the Central Bureau of Investigation (CBI) probe, he alleged.

"As this case is similar to that of mine, I am confident that I will come back," he said referring to the case in which Justice Sanjeev Prakash Sharma on Friday ruled: "An act of relationship entered by an individual with another female or male, as the case may be, while his/her spouse is alive, would be an act amounting to adultery and would be considered as an immoral act so far as the Indian society is concerned.

In view of tightening law and order situation, the Rajasthan government on Friday effected a major reshuffle of the Indian Police Service officers. All 66 senior police officers have reportedly been asked to join with immediate effect.

Ashok Gehlot administration Thursday midnight effected a major bureaucratic rejig comprising 103 officers.

Amidst the rejig, Rajiv Swarup (IAS:1985:RJ) was appointed as the new Chief Secretary of the Government of Rajasthan. Presently, he is serving as Additional Chief Secretary, Home, Home Guards, Jail & Rajasthan State Investigation Bureau and Ex-Officio Chief Vigilance Commissioner and Additional Chief Secretary, Transport Department, Rajasthan, Jaipur.

Rajasthan achieves one of the highest recovery rates in the country

As per state government’s official data and several media reports, the recovery rate of COVID-19 cases in Rajasthan has crossed 77% for the first time whereas active cases continue to be below 3000. The number is 2762 as of June 17 evening. When asked about the reasons for the encouraging trend Additional Chief Secretary, Health and Family Welfare Rohit Kumar Singh (IAS:1989) said;  “Aggressive testing leading to early detection of cases combined with quality healthcare has helped Rajasthan achieve one of the highest recovery rates in the country. Mission LiSa has enabled us to identify high risk and vulnerable cases earlier than usual again contributing to higher recovery and comparatively less mortality.”

Three ADG rank officers promoted in Rajasthan

The Rajasthan government has promoted three senior IPS officers of the rank of Additional DG to the rank of Director General (DG) on June 5, 2020. The Department of Personnel of the state government issued orders to this regard.

Rajasthan CM Ashok Gehlot appears to have sidelined his Deputy CM Sachin Pilot. This is in sync with Pilot's clean image that instead of taking confrontationist approach, he focuses on nurturing his political future. He refrained himself from opening any front against Gehlot as part of the strategy, this is what bureaucracy of Rajasthan talks about Pilot.

When Congress took over mantle in the state Pilot lost the battle of CMship to Gehlot but appointed as Deputy CM. Old guards had initially thought that gradually Rajasthan will be Pilot-centric and the grand old man Gehlot would gradually disappear from the scene.

Initially Pilot had a fair say in the administrative matters of the state but contrary to the perception, Gehlot has cut him to size and today he is just like a favoured minister. Taking cue from the power equation, MLAs too distanced themselves from Pilot.

Insiders say that Gehlot is a seasoned politician to settle such issues but Pilot does not appear to be a looser like Navjot Sidhu in Punjab. Pilot knows well that present moments are for Gehlot but future lies with him.

Insiders in state bureaucracy say that Pilot has started considering himself under probation period and has been nurturing his skills and acceptability to take up the top job in Rajasthan in the future.

Rajasthan reposts 10 IAS officers

The Rajasthan government has transferred 10 IAS officers including the National Health Mission (NHM) director Samit  Sharma who recently courted controversy for alleged irregularities in the recruitment process of community health officers in the state.

 

Sharma was transferred as the commissioner of the labor department. Udaipur Divisional Commissioner Bhawani Singh Detha is appointed the secretary to the local self-government department whereas Agriculture commissioner Vikas Sitaram Bhale is appointed Udaipur divisional commissioner.

Food and civil supplies secretary Mugdha Sinha is transferred to science and technology department. Om Prakash is appointed as commissioner in the agriculture department.

 

Secretary of local self-government department Siddharth Mahajan is appointed as secretary food and civil supplies department while Virendra Singh is appointed as commissioner medical education department.

 

Director of local bodies Pawan Arora is appointed as commissioner of Rajasthan Housing Board. Ujjwal Rathore was appointed as director of the local bodies department. Ngikya Gohain is transferred as joint secretary in the water resources department.
