Hyderabad (10.01.2023): The Telangana High Court today (10.01.2023) quashed the order of the Central Administrative Tribunal (CAT) allocating Telangana cadre to the incumbent Chief Secretary of the state Somesh Kumar (IAS: 1989: AP).
After the division of Andhra Pradesh (AP) and Telangana Somesh Kumar was allocated AP Cadre but he continued in Telangana on a CAT order which the Telangana HC in its 89 pages judgment reversed leaving him and the respective state governments in a quagmire.
The CAT allocated Kumar Telangana as his cadre in 2016. The Union government, which had made the allocation of the cadre, appealed to the Telangana High Court to strike down the CAT order.
Now, there is a tricky situation for Kumar and the respective state governments (AP and Telangana).
Following the HC’s fresh verdict Telangana will need a new Chief Secretary, Andhra Pradesh will have to accommodate Kumar as per his seniority and rank while Kumar will have to relocate to another state at the fag-end of his career. Reportedly, the High Court refused to stay the order to enable Kumar to appeal in the Supreme Court.
