New Delhi (22.10.2024): The Supreme Court (SC) of India (SC) slammed Enforcement Directorate (ED) for its unpardonable act of calling persons at short notices, keeping them awake all through the night and arresting them the next day. The arrest and interrogation techniques prescribed by the federal agency is unconstitutional.
The SC while hearing the petition filed by retired IAS Anil Tuteja said: “We are worried about what the future will be. There is something known as Article 21 of the Constitution of India (right to life and liberty) of the citizens. This is unpardonable and simply not done that you interrogate a person through the night and take him into custody the next day.” The court was hearing the petition of Tuteja who was arrested in Chhattisgarh liquor scam case in April this year.
The Additional Solicitor General (ASG) SV Raju said that officer concerned Naresh had resigned. “We have issued a circular and are taking action against the said officers. Perhaps the officer has resigned because of that,” ASG Raju said.
