Covid-19: SC to take up urgent cases only, rest to be heard via VC

Chief Justice of India (CJI)  Sharad Arvind Bobde has decided that the Supreme Court will hear only “extremely urgent” cases in the coming week, while ruling out complete shutdown of the apex court. Only one bench will be available to take care of judicial work. And if necessary, it will sit on Wednesday for important proceedings.

According to CJI, a Bench of two Judges, as may be necessary to hear extremely urgent cases, will be available to transact judicial work. At the same time, he told that there will be a facility to conduct hearings through video conferencing. Towards that end, rooms with requisite facilities for this purpose will be made available according to the convenience of  lawyers

Further, in order to get the case listed before the bench, the advocate concerned should indicate the extreme urgency of the matter in writing before the bench.

After other services in the Armed forces. Supreme Court of India has ruled granting permanent commission for women officers in the navy. The SC says that women can sail with the same efficiency as male officers and there should be no discrimination.
Similar ruling was given in the case of the Army when SC ruled that women can also join the combat operation like men as an officer with permanent commission.

While speaking at the inaugural ceremony of International Judicial Conference at Supreme Court of India in New Delhi on February 22, 2020, Justice Arun Mishra said that judiciary was protector and guardian of the ground norms of respective countries. Indian Prime Minister Narendra Modi inaugurated the conference and it was widely underlined when Justice Mishra praised Modi terming him as an "internationally acclaimed visionary" and a "versatile genius, who thinks globally and acts locally". No wonder he is the favourite judge of the regime!

Equating the legislature, executive and judiciary as heart, brain and backbone of democracy respectively, he underlined that these three organs have to work independently but in tandem to make the democracy successful. Kingdoms are seen falling apart where judiciary has failed to contribute to effective governance and hence judicial system has a significant role to play in the ever-changing world, said Justice Mishra.

He further underlined that Indian systems might be different at international level but challenges faced by the judiciary at national and global levels are more or less the same.

Amid the growing concern among masses of being left out and deprived of its gains, the sense of injustice, inequality looms large. He further said that in the present era, technology and trade are increasingly evolving as weapons of war and before it becomes lethal like Coronavirus, it has to be taken care of by all of us alike.

Praising and acknowledging the presence of PM Modi and people from the legal fraternity, Justice Mishra added, “Your presence indicates that we are united in our steely resolve against the invasion of human rights and terrorism. Our collective efforts will pave the way for global developments by evolving common standards.”

Despite who’s who of power corridor in Delhi attending a private function of a joint secretary-level officer that had failed to catch eyeballs of many in Lutyens but people in the power corridors are still whispering about the affair cautiously even a week has gone by.

'Mundan Sanskar' of the daughter of a Joint Secretary level IAS officer working in the Commerce Ministry has become a matter of discussion for many senior officials these days. What they appear to be astonished about is that there are over four hundred Joint Secretary level officers across all ministries and departments in the Govt of India but this seems to be something very unheard of that the top echelons of the country did not miss to attend the invitation.

So much so that the event was attended by President of India, Prime Minister of the country, Union Home Minister Amit Shah, Defence Minister Rajnath Singh, Commerce/Industry minister, Health/IT Minister, Chief of Defence Staff General Vipin Rawat, chief ministers of several states and dozens of former Union ministers (UPA)  and Union secretaries too attending the function but it went unnoticed in Lutyens' Delhi which keeps track of the fact even how many times PM clapped during the budget presentation.

The Apex Court Supreme in a path-breaking ruling said that assemblies and Parliament should rethink whether Speaker of a House should continue to have powers to disqualify lawmakers as they belong to a particular political party.

The SC recommended that Parliament should consider Speaker’s disqualification powers with a permanent Tribunal headed by a retired SC Judge or a retired Chief Justice of a High Court' or some other mechanism to ensure swift and impartial decisions.

Reality check: SC asks SG to produce letter of support placed before Maha Guv

Following an urgent hearing on Sunday on the legality of the formation of Government in Maharashtra the Apex Court has reportedly directed the Central Government through Solicitor General Tushar Mehta to produce before Court tomorrow at 10.30 am the letters of support on the basis of which the Maha Governor Bhagat Singh Koshiyari, on Saturday early morning, decided to invite BJP to form government.

The SC bench comprising Justices N V Ramana, Ashok Bhushan and Sanjiv Khanna ordered: “Issue involved is the Governor's decision dated 23/11/19 inviting them to form government is unconstitutional. For the adjudication of this issue we request Solicitor General Tushar Mehta to produce the two letters by tomorrow morning 10.30”.

The order was passed after an hour long hearing of Senior Advocate Mukul Rohatgi (for BJP), Solicitor General Tushar Mehta, Senior Advocate Kapil Sibal (for Shiv Sena), Senior Advocate Dr A M Singhvi (for NCP).

SC writes history with Ayodhya verdict but NaMo Govt incredible too!

With the pronouncement of judgment on title suit on Ramjanmabhoomi and Babri mosque, a long standing dispute between Hindu and Muslims seems to be over with all credit goes to the judiciary but no less acclaim could be given to the NaMo administration as the matter has been resolved during the time Narendra Modi at the helm.

What is more interesting is that the country responded very well to the decision except a few aberrations. Unlike phrase used by wordsmiths in such a situation that ‘eerie silence prevails’, now people are of the view that the Supreme Court has decided the matter in most judicious manner and most importantly unanimously. So let’s bury the hatchet and move on.

Despite the provocation made by the opposition that Ram Temple will be made an election issue by the BJP to polarize Hindu votes in view of Sangh Pariwar demanding day-to-day hearing in the court and VHP putting pressure on the government to bring a legislation in Parliament in this regard. They were also planning to start a movement similar to their movement in 1990s. But suddenly the VHP went into shells and postponed the matter for post election scenario but for obvious reasons.

The PM was very categorical when he had made it clear in election rallies that the matter is in the court and let the court take a call on it. He was so cautious about his constitutional obligation that despite visiting Faizabad for an election rally around 30 kilometres away from Ayodhya, he avoided temptation of paying his obeisance to Ram Lalla.

The day of decision on one of the most vexed issue of the modern times passed normally and the morning is even better with history being made not only in Ayodhya but also at Kartarpur. The Ayodhya issue that has an around 500-year old history soaked with blood of innocent people and if this was none of our business kind of attitude of British that made the matter remain indecisive. A particular blend of politics kept it alive post-independent and later on the issue turning into vote-bank politics without any exception in terms of beneficiaries.

But for the apt handling of the issue by the present dispensation has not only saved many innocent lives but country as such has come to the term to put a lid on political Djin of Ayodhya. The government has done a Jammu and Kashmir in Uttar Pradesh with taking all possible measures supported by intelligence inputs. But this was not enough, the Sangh Pariwar has entrusted senior functionaries like Krishna Gopal and Ram Lal to establish dialogue with Muslim community and Hindus to accept the judgment whatever it could be.

Jamiat Ulama e Hind chief Maulana Arshad Madani meeting RSS chief Mohan Bhagwat and Mehmood Madani meeting Krishna Gopal was something unimaginable. Two important seats of Nizamuddin Aulia and Ajmer Sharief appealing to accept the SC judgment the way it is has worked among the Muslim community.

Besides the judiciary and the Modi government, the department of justice will also be remembered whenever this issue is talked about. They were not just bystanders but played their bit in the making of the history and witnessing it with sense of achievement but silently. But they will enjoy the glory looking at it hindsight for sure.
