But what's it if not a scam when you go on hounding an honest public servant, get scolded time and again by established institutions of the state, and still you continue with your misdemeanor. It requires a lot of grace and yes intelligence to admit that one has been wrong. Nadda lacks both these qualities in ample measures. And the result is out there: the Central Administrative Tribunal (CAT) has stopped the fresh proceedings initiated on January 21, 2017, by AIIMS and Union health minister J P Nadda to write the annual performance appraisal report (APAR) of whistleblower IFS officer Sanjiv Chaturvedi. The tribunal has also issued a notice to AIIMS, Union health secretary, and others to respond within four weeks. The case pertains to the health minister writing an adverse APAR report for Chaturvedi who had then approached the tribunal seeking contempt proceedings against the AIIMS, Union health ministry, and others. The CAT order was issued on February 6 on a petition filed by Chaturvedi who came to know about his APAR for the period September 17, 2014, to March 31, 2015, from authorities at the AIIMS, Delhi. The CAT in its February 3, 2016, ruling had held that an APAR cannot be written by any authority if the officer has not worked for a period of 90 days in continuation. Efforts to start the APAR process for the period in 2017 shocked Chaturvedi, a Magsaysay Award winner and IFS officer. He then approached the CAT seeking relief and initiating contempt proceedings against the AIIMS, Union health ministry, and others. After going through available records, CAT chairman Justice (Rtrd) Permod Kohli ordered that the petition for initiating contempt proceedings against the alleged violation of the order dated February 3, 2016, would be allowed and the Central government should file a response within four weeks explaining their position. Chaturvedi was removed from the post of chief vigilance officer (CVO) of AIIMS in August 2014. The official had then claimed that he was removed for acting against corrupt officials.
