The National Human Rights Commission (NHRC), in an order earlier this month, has said the incident was "an established case of violation of human rights" and has pulled up Sunil Kumar, the then Deputy Commissioner, for "discourteous and unseemly behaviour". Sahay, the Deputy General Manager (HR/EDC) of NTPC - Patratu Task Force, Ranchi, had levelled allegations of assault against Sunil Kumar, an IAS officer. According to NHRC, the inquiry report of the Additional Chief Secretary, Department of Home, Prison and Disaster Management, "prima facie substantiates" the allegation levelled by Sahay and makes this "an established case of violation of human rights". "After a detailed inquiry into the matter, it has been concluded…. that the conduct of the then Dy Commissioner, Hazaribagh, Sunil Kumar was not in terms of the All India Service (Conduct) Rule, 1968 and that he is guilty of discourteous and unseemly behaviour," it read. The Commission further states that a notice under Section 18(a)(i) of the PHR Act, 1993 will be issued to the Chief Secretary of Jharkhand directing him to show cause within four weeks as to "why compensation may not be recommended to be paid to the complainant for violation of his human rights". NHRC has also said, "since there is no previous complaint against the officer (Sunil Kumar), this act may be considered as an aberration."
