New Delhi (27.07.2023): When the Government approached the Supreme Court with a plea to extend the tenure of Sanjay Kumar Mishra (IRS IT: 1984) up to October 15, 2023 everyone was awestruck. One section believed that now, the SC would embarrass the Government while the other section believed that the government won’t anything without gauging its implications and proper homework. 
Actually, the Supreme Court on Thursday extended the term of the Director of the Directorate of Enforcement (ED) SK Mishra till September 15 in "larger public interest". Mishra's term was to end on July 31 as per the July 11 judgment which held the previous extensions given to the officer to be illegal.
But when the decision of the SC tenure was pronounced, Shah in one of his tweets had categorically warned those rejoicing over the Hon'ble SC decision on the ED case are delusional for various reasons. He added that the SC has upheld the amendments to the CVC Act and the Delhi Special Police Act which were duly passed by the Parliament. He said that the ED Chief will change but the framework of law, power and provisions of PMLA would remain the same. In a way, the HM underlined that the SC has reinforced Centre’s powers. 
Presently the tenure of ED Director is fixed for 2 years and the Centre can give three successive extensions of one year each up to maximum for five years.
