On June 2, the Central Administrative Tribunal (CAT) upheld the plea of Indian Forest Service (IFC)Officer Sanjiv Chaturvedi on his inter-cadre deputation and directed the Union of India and the Appointments Committee of Cabinet to implement its order in this within three weeks. The order said, "the respondents (including ACC) are directed to decide the matter of inter-cadre deputation of the applicant, within a period of 3 weeks, from the date of receipt of this order, positively."
The order provides one more opportunity for the Modi administration to come clean. Indianmandarins has learnt that the administration has no chance of winning this case even if it opts for going into an appeal. Officials believe that the administration has done enough to molly coddle and humor the ego of a certain minister who got the whole administration trapped into a battle that was already lost even before it began. "The only way to get out of the huge loss of image of the Prime Minister is to straight away implement the CAT order. It's no big deal," said several senior officers.
This is the third time in the past 6 months when the CAT issued a time-bound direction to the Union of India and the ACC which is headed by the Prime Minister. The first direction was issued on November 5 last year when the Tribunal fixed a deadline of 5 January for the ACC to pass orders in Sanjiv's case. Meanwhile, the Uttarakhand Govt withdrew its NOC which was restored on February 24 this year. The CAT again passed directions on April 27 for expeditious implementation of its order on inter-cadre deputation of Sanjiv within two weeks. The indifference of the government opened up this case once again on June 2.
