New Delhi (21.08.2024): In an unfortunate development, Enforcement Officer of the Enforcement Directorate Alok Kumar has committed suicide. Kumar was under investigation in the alleged bribery case involving Sandeep Singh, Assistant Director, ED, but was not named as accused.
Sources said that Kumar was quizzed by the CBI based on the statement of Sandeep Singh but his role in the offence was not established, therefore he was not arrested. Alok Kumar was on deputation in ED from Income Tax Department.
ED registered case under PMLA against Sandeep Singh and conducted search operations at his house under PMLA, 2002. A joint search operation was conducted at his office by ED and CBI. The action was in consequence of FIR and arrest of Sandeep Singh by the CBI.
However, there are certain jurisdiction issues in this. CBI conducts searches under BNSS and ED has PMLA, where is the provision for “joint search operation”? If there were incriminating materials at the premises of the accused, in this ‘joint search operation’, which agency seized the said incriminating materials? It’s CBI’s FIR, why did ED jump into CBI’s operation? There are many such unanswered questions.
