uncertainty-looms-large-over-the-elevation-of-joseph-as-sc-judgeUncertainty looms large around appointment of K M Joseph as Supreme Court judge. The Centre has taken a view that there are many qualified judges who have not been considered for elevation, and Schedule Caste and Tribe have not been considered. The Supreme Court collegium has recommended the elevation of Uttarakhand chief justice K M Joseph as SC judge. Now the SC believes that the government is unlikely to come in the way of appointing Uttarakhand chief justice KM Joseph as an SC judge. Joseph's elevation was recommended unanimously by the collegium that included Justice Chelameswar, who has now retired. After the retirement of Chelameswar, the collegium has been reconstituted. Therefore, the recommendation of Joseph's appointment will requirement fresh endorsement from the Centre. Justice A K Sikri has occupied the position in collegium after retirement of Chelameswar. The resolution is yet to reach the government for endorsement. This resolution, which is yet to be forwarded to the government, was signed by justices Dipak Misra, Chelameswar, Ranjan Gogoi Madan Lokur and Kurian Joseph the five most senior SC judges. The Modi government had returned the initial recommendation to promote Joseph to the Supreme Court in April, saying it does not appear to be appropriate. The government had opined that there are other more senior deserving judges, the Kerala high court is already adequately represented in the apex court and judges from the Scheduled Castes and Tribes are absent.
