New Delhi (09.11.2022): Justice D Y Chandrachud has taken over as the 50th Chief Justice of India on Wednesday after former Chief Justice of India Uday Umesh Lalit retired on Tuesday. CJI Lalit took over on August 27, 2022 for a tenure of 74 days. CJI D Y Chandrachud will have a tenure of two years, which is the longest for a CJI in over a decade.
But the long tenure of CJI Chandrachud will have many challenges to face apart from ensuring the continuity of institutional reform already in progress. Remarks by Union Minister for Law and Justice Kiren Rijiju on the collegium system of appointing judges and its lack of accountability clearly indicate a faceoff between executive and judiciary in the days to come.
Rijiju repeatedly talked about “working with the present system till the government comes up with an alternative mechanism”. These remarks were reiterated when the collegium headed by CJI Lalit, of which Justice Chandrachud was a part of, failed to agree on recommending judges to the Supreme Court. The discordant notes among senior judges over the names through a written note when meeting physically was not possible played out in public. The proposal was eventually dropped but not before making a dent in the image of the collegium.
