New Delhi (12.08.2021): The Centre has not taken any decision on the fate of IAS officer Shah Faesal even after two-and-half years of his resignation and the matter is still pending with the Government. As per the rule, if no decision has been taken and the concerned officer gives in writing, his resignation gets withdrawn automatically.

Faesal’s resignation is not accepted as yet which technically means that he might join the service any time. The DoPT rule suggests that the resignation of any IAS officer can be accepted if the officer is under suspension which is not the case with Faesal.

He topped the UPSC examination in 2010 to become the first Kashmiri but he resigned in 2019. He launched a political outfit Jammu and Kashmir People’s Movement (JKPM) and became the bitter critic of making Article 370 inoperative in Jammu and Kashmir. The government arrested him under the Public Safety Act. He, later on, relinquished the post of JKPM. As per DoPT the matter of resignation of Shah Fasel is still under consideration.

Reportedly Faesal wanted to travel to the US and settle there after his release, but he wasn’t allowed to do so. He was given two choices: either to carry out his political activities but without touching Article 370 revocation or rejoin the civil service. Most probably he will opt for the second choice.
