Grievances & Pensions, Atomic Energy and Space, Dr Jitendra Singh informed
the Rajya Sabha in a written reply that states can't withdraw its consent to
the CBI in any ongoing case with retrospective effect; it may be withdrawn only
prospectively. He further clarified that in the cases which
are referred by the Constitutional Courts, states can't deny CBI entry into
their territory as these cases do not require the consent of the State. He pointed out that constitutional courts can
entrust any case or class of case for CBI investigation in exercise of inherent
jurisdiction even without the consent of the respective State Government. He also read out the DPSE Act, 1946 to make
his points clear.
