Legal problems in the selection of Telecommunications Consultant India Limited (TCIL) CMD continue to keep the post vacant since February 1, 2016. A K Gupta (Director- Finance) continues to hold the additional charge.
The problem arose because, when the PESB didn't select him, Director-Technical Rajesh Kapoor filed a writ petition in a single judge bench of the HC which ruled in favour of PESB. He challenged the judgment a two-judge bench that reversed the single-judge bench's order. This made the PESB file an SLP in the Supreme Court.
While advertising for the post, the PESB laid down the condition that on the date of occurrence of the vacancy, internal candidates should not be more than 58 years of age and the last date for submitting the application was April 10,2015.
Further, the DPE's (Dept of Public Enterprises) guidelines of 2005 provide that a person (an internal candidate) who is having two years of residual service will be eligible to apply.
In his case, Rajesh Kapoor was above 58 years of age as on February 1, 2016, but had more than two years of residual service from the date of vacancy to his date of retirement January 31, 2018.
