New Delhi (03.08.2023): “An expert body’s opinion is not subjected to judicial review unless it is actuated with malice or abound with arbitrariness. Neither are present in the case of both the petitioners” said the Ranchi High Court endorsing PESB’s recommendation dated 19.05.2023 for the post of Director (Technical), MECON.
It may be underlined that PESB had selected and recommended Amit Raj (Senior GM, MECON) for the post of Director (Technical) in MECON; a Ranchi based Central PSU.
While recommending Amit Raj PESB had categorically underlined that its was subject to the final outcome of the WP(S) No.788 of 2023 filed in the Hon'ble High Court of Jharkhand at Ranchi.
After PESB circulated (03.05.2023) the names of shortlisted candidates on a petition was filed in the Ranchi Hight Court praying for the rectification and re-issuance of shortlisted candidates permitting the petitioner to appear in the selection meeting to be held on 19.05.2023.
Having Ranchi High Court endorsed PESB’s recommendation MECON may hope to get a new Director (Technical) subject to requisite clearances and ACC approval.
