The consumer affairs department will cite the latest change in rules, done specifically to bring such 'institutional consumers' under the ambit of the law. The law had specified that items procured in bulk for own use could not be sold as retail items. The modified rule was notified on June 23 and will come into effect from January 1. In its order, the Supreme Court had said that provisions of legal metrology rules for the retail sale of packaged commodities would not apply to institutional consumers such as hotels. It had ruled that neither the Standards of Weights and Measures Act nor the Legal Metrology Act would apply so as to prohibit the sale of mineral water in hotels and restaurants at prices which were above the MRP.
