PM meets 18 Lok Sabha MPs individually: Larger significance?

Has PM Narendra Modi taken matters related to West Bengal Assembly elections in his own hands? Meeting all 18 Lok Sabha MPs from the state individually appears a signal of sort. Political experts say that this is an attempt of giving a clear message that the BJP would contest Assembly elections of West Bengal with its full strength to change the government?

In one of the meetings with MPs of the state, the PM told one of them that winning West Bengal Assembly election is not like any other Assembly election rather it is important for the nation. Union Home minister Amit Shah will be spending two-three days every month in West Bengal. He has already started addressing pro-CAA rallies and PM is also having various programs in the state.

Sources said that for Sangh Pariwar having control over bordering state with huge infiltration coming in is of paramount importance. After winning Assam BJP aims at West Bengal where allegedly huge number of infiltrators have settled and incumbent Mamata Banerjee not taking any remedial measure to check the phenomena.

Reportedly, the PM is asking MPs about the aspiration of people, organisational requirement and governmental assistance. The new team under J P Nadda will have a representative from West Bengal besides the possibility of one more induction in the council of minister if reshuffle or expansion happens. But PM monitoring the situation will keep others on toes.

The CBI has sought arrest warrant against former Kolkata police commissioner Rajiv Kumar as Tom and Jerry chase between the CBI and Kumar is continuing from long. Meanwhile, the CBI has accused him of suppressing evidence required for preparing final charge sheet in Saradha scam case. He has been asked to appear before CBI on September 20.

 

As claims CBI Kumar has not only been ignoring summons but evading arrests as well so the investigation agency had sent letters to West Bengal DGP, CS and HS to help trace Kumar. The CBI wants his custody as it will not only help gather more evidences about Saradha scam but it has also some political implications as well in a state where the saffron party at the Centre has an eye.

 

Officially Kumar is on leave till September 25. CBI conducted searches at various locations across Kolkata looking for Kumar in connection with Saradha scam

Creating narrative and ground reality are two equally important things and ‘Didi’ appears to understood it very well. At least meeting of the WB CM Mamta Banerjee with the PM Modi and agreeing to meet Amit Shah suggests so.

Mamata might have been able to address a section of her voters in West Bengal but constantly being at the loggerhead with the Centre did not produce any good to her.

In fact, Didi’s one of the dearest projects lying with the home ministry has been changing name of West Bengal to Bangla. On the other hand It is believed that the moment name change takes place memory of partition of Bengals fades away which Sangh Pariwar doesn’t endorse. This has apparently been the reason that Mamata needs to meet Shah which she might have agreed reluctantly.

But the issue on which Didi failed to get approval from a leader like Rajnath Singh, getting approval of Amit Shah will be an onerous task. Let’s see how long this bonhomie continues as Shah does not give any concession to opposition.

So is it the Modi government that has brought ‘Didi’ to knees or West Bengal CM is here to embarrass the Centre as CM Mamta Banerjee will be meeting PM Modi on September 18?

 

Didi has been at the loggerheads with the Centre and had opened a front so much so that she did not attend swearing in ceremony of the PM who used to send shawl to him regularly on occasions. She did not attend even the Last NITI Aayog meeting of which CMs are ex officio members. In-between many issues have cropped up between WB and the Centre including NRC and Sharda Chit Fund scam besides few other administrative issues.

 

Political killings have become norm in West Bengal and both the sides are commercialising environment eyeing political gains so Mamata likely to take up all such issue with the PM. Even the PM may talk to her on deteriorating law and order situation and some other. But one thing is sure that this meeting will have lots of political bearings. Mamata still opposes many Central schemes in the state and did not allow them to be implemented.

The less-than-favourable results in her state in 2019 LS Polls have prompted West Bengal CM and TMC chief Mamta Banerjee to meet Election Strategist Prashant Kishor on Thursday, June 6, in Kolkata. Banerjee is reported to have signed PK to help the TMC with its post-LS Polls strategy and shape a better campaign plan for the 2021 Assembly elections in the state.

 

So after advising the BJP, Congress, and YSR Congress PK may now be working for Didi. But somehow his latest forays in West Bengal take attention to Bihar Chief Minister and Janata Dal (United) leader Nitish Kumar and his future strategy.

 

PK is national vice-president of Nitish’s party. It is difficult to believe that PK could have met Mamata without Nitish’s prior consent. Though there are speculations that PK is on the verge of parting ways from Nitish and his JD (U). But in case these speculations are not true then certainly the move on the part of the poll strategist to come together with Mamata Banerjee is politically significant.

 

It is more than coincidence that PK’s Bengal move comes close on the heels to Nitish-led JD (U) denying to accept portfolio in Modi Govt. 2.0. And to add insult to injury this was followed by Bihar cabinet expansion where eight party MLAs were administered oath of office while those from the BJP were left in the cold. This turned out to be like a tit for tat between Centre and State, or between BJP and JD (U) though the two parties continue to be in alliance despite their relations getting visibly estranged. 

 

So isn’t it apt to assume that Nitish has started testing waters afresh? Among other reasons because of which Modi won 2019 LS polls is the fact that Mahagathbandhan had no face to match him. As an astute player of politics who could know this better than Nitish Kumar. He is reputed to have the ability to smell opportunity before others. Yet, 2019 proved to be a lost year for him like may be a few other peers in the Opposition. So he may not like to lose it again in 2024. 

 

Whatever may be the reason, purpose, intent and objective of PK joining hands with Didi, one cannot deny that the move is loaded with quite a few possibilities. And these are still going to take some time to unravel.

Calcutta HC to examine validity of DSPE Act and CBI

The Calcutta High Court will examine and decide the validity of the Delhi Special Police Establishment Act and its baby called the Central Bureau of Investigation (CBI).


Justice Protik Prakash Banerjee has ordered that the case relating to the validity of the DSPE Act be placed before a Bench of two or more judges following the submissions of Amicus Curiae Phiroze Edulji.

 

The questions framed by the High Court in relation to the case are as follow:

 

Whether the Delhi Special Police Establishment Act, 1946 is a valid piece of legislation?


Whether the Central Bureau of Investigation is an organ or a part of Delhi Special Police Establishment?

 

In a Constitution having federal form with distinct feels of legislation apportioned to the federal legislature and/or the federating legislature with corresponding executive power where law and order and their maintenance are part of the power given to the federating states whether a federal police force even for investigation can be made by central legislation without following the procedure established by the Constitution of India for central legislature making laws which would be enforceable in each of the States?

 

Further, taking note of the fact that the Supreme Court has granted a stay on the Gauhati High Court judgment in this regard, the Calcutta High Court has also framed the following questions:

 

What is the effect of an order of the Supreme Court which stays the operation of a final order of a Division Bench of a High Court which holds that a Central Statute is not a valid piece of legislation?

 

Whether admission of special leave petition and stay of a final judgment of the nature referred to above would mean that the Supreme Court has declared any law by such interim order of stay?

 

Amicus Curiae Edulji submitted that the case involves substantial questions of law as to the interpretation of the Constitution of India. He, therefore, requested the Bench to place the matter before a Bench of three or more judges.


The Court noted his submissions and ordered that the matter be placed before the Chief Justice for the constitution of an appropriate Bench.

 

“I think that these are the questions, which ought to be decided by a bench whose judgment would be binding on all other Courts of this State. Accordingly, I most respectfully request that the matter be placed before the Hon’ble Chief Justice/Acting Chief Justice for His Lordship to consider whether or not to constitute a Special Division Bench or a Special Bench comprising two or more judges for deciding the law involving interpretation of the Constitution of India”, the High Court stated in its order.

Bengal officials might have already got the message: it doesn't help to be Mamta's men. If they have not, they should decode the SC stand taken on Tuesday when the apex court declined to let go the West Bengal Chief Secretary and the Director General of Police (DGP) in a contempt plea by the CBI allegedly for not cooperating with it in the investigation of the Saradha chit fund scam.

 

Rejecting the plea for the discharge of two top state officers, the bench of Chief Justice Ranjan Gogoi, Justice Deepak Gupta and Justice Sanjiv Khanna directed the Bureau to file a separate application on its prayer relating to something "very serious" about the former Kolkata Police Commissioner Rajeev Kumar mentioned in the status report.

 

"Something is brought to our knowledge. It is very serious. Should we close our eyes to that? It warrants some orders," the court said.

 

For this purpose, the apex court asked the Bureau to file a separate application with supporting material relating to something "very serious" about Rajeev Kumar after it perused the status report on the quizzing of the officer by the CBI in Shillong last month.


The status report was submitted in a sealed cover and it was put back in the cover after judges perused it.

 

Observing that since the status report was in a sealed cover and the other side does not know about its content, the court said that it cannot pass any order.


Rajeev Kumar had submitted to the questioning by the CBI on the directions of the top court which came on the contempt plea filed by the investigating agency.


The CBI has alleged that the Chief Secretary, DGP of the state and Rajeev Kumar were not co-operating in the investigation of the Saradha chit fund scam and were holding back the evidence initially collected by the state SIT before the probe was handed over to it.

 

The court gave CBI 10 days' time to move the application and two weeks' time to Rajeev Kumar to respond to it.

 

"It is after that we will determine the charges and counter-charges after hearing both sides," CJI Gogoi said in his order.

 

The top court in the last hearing of the matter on February 27 had directed the CBI Director to file an affidavit stating "full facts" of the alleged "incomplete and incorrect" information furnished by Rajeev Kumar relating to the evidence collected by the state SIT investigating the Saradha chit fund scam before the court handed it over to the CBI.

Bengal CM Mamta Banerjee is seen lending a helping hand to fodder scamster and former Bihar CM Lalu Prasad to consolidate her national political ambition.


This is reflected in the Kolkata police sending a notice to CBI joint director Pankaj Srivastava, asking him to appear before the investigating officer at Bhawanipur police station within seven days in connection with a complaint registered against him last month.

 

One Vaibhav Khattar has filed a complaint with the Bhawanipore police station about the CBI illegally detaining and torturing him in a case in which he claimed he had no connection.

 

Khattar, an employee of a private mill in West Bengal, was raided by the federal investigating agency in August last year in connection with its investigation into alleged involvement of the mill owner, Dipesh Chandak, in a case of multi-crore fodder scam that had happened in Bihar in the early 90s.

 

The Kolkata Police summon to the CBI joint director (east) comes close on the heels of a fierce tiff between the premier investigating agency and the city police over its action against outgoing Kolkata Police commissioner Rajeev Kumar in the Saradha chit fund scam.
