Khemka moves to CAT against non-empanelment?

If some key sources are to be believed 1991 batch Haryana cadre IAS officer Ashok Khemka has moved to Haryana Bench of Central Administrative Tribunal (CAT) against his non-empanelment as Additional Secretary in Govt of India.

It may be underlined that NaMo administration had on 09 October 2019 cleared the empanelment of 31 IAS officers belonging to 1991 batch to hold Additional Secretary/AS Equivalent post in Govt of India. Usually, the review of empanelment of a batch is considered along with empanelment of immediate junior batch. 

Those in the know of the affairs say that Khemka too would have been waiting to find his name on the review list expected along with the empanelment list of 1992 batch of IAS officers which was cleared last Monday. Cases of review of 1991 batch was not taken up along with 1992 batch empanelment which would have prompted Khemka to move to CAT.

As Indianmandarins had reported first early morning today the NaMo administration on Wednesday cleared the appointment and reshuffle of Additional Secretary level posts. Several 1991 batch IAS officers were posted as Additional Secretary in Govt of India and various others were elevated (In-situ) from Joint Secretary to Additional Secretary rank. They are:

  1. Amit Yadav (IAS:1991:UT) appointed as DG, Directorate General of Foreign Trade, Ministry of Commerce & Industry in the rank and pay of Additional Secretary. Presently, he is JS  Department of Telecom.
  2. Rakesh Sarwal (IAS:1988:TR) appointed as Additional Secretary, Department of Higher Education. Presently, he is  Additional Secretary, Ministry of Food Processing Industries. He replaces Sukhbir Singh Sandhu on his appointment as Chairman, NHAI.
  3. Sukhbir Singh Sandhu (IAS:1988:UK) appointed as Chairman, National Highways Authority of India. Presently, he is Additional Secretary, Department of Higher Education.
  4. Ms. T. Rajeshwari (ISS:1985) appointed as Additional Secretary, Ministry of Statistics and Programme Implementation. Presently, she is Additional Secretary, Department of Water Resources, River Development and Ganga Rejuvenation, Ministry of Jal Shakti.
  5. Arvlnd Singh (IAS:1988:MH), presently in the Cadre, appointed as Chairman, Airports Authority of India.
  6. Ashish Upadhyay (IAS:1989:MP) appointed as AS&FA in the rank and pay of Additional Secretary, Ministry of Power. Presently, he is Joint Secretary, Ministry of Coal.
  7. K Sanjay Murthy (IAS:1989:HP) appointed as CEO & MD of Delhi Mumbai Industrial Corridor Development Corporation, Ministry of Commerce & Industry. Presently he is Additional Secretary, Ministry of Housing and Urban Affairs.
  8. Keshav Kumar Pathak (IAS:1990:BH), presently in the Cadre, appointed as Managing Director, National Highways & Infrastructure Development Corporation Ltd (MD, NHIDCL).  
  9. Ganji Kamala V Rao (IAS:1990:KL), presently in the Cadre, appointed as CMD,  India Tourism Development Corporation Ltd (MD, ITDC).
  10. K Moses Chalai (IAS:1990:MN) appointed as Secretary, North Eastern Council Secretariat (Ministry of DONER). Presently, he is Additional Secretary, Ministry of Women and Child Development.
  11. S Gopalakrishnan (IAS:1991:TN) appointed (In-situ) as Additional Secretary, Ministry of Electronics and Information Technology. Presently, he is Joint Secretary, Ministry of Electronics and IT.
  12. Pramod Kumar Tiwari (IAS:1991:AM) appointed as DG, Bureau of Indian Standards (BIS), Ministry of Consumer Affairs, Food and Public Distribution in the rank & pay of Additional Secretary. Presently, he is JS Department of Food and PD.
  13. Ms. Debashri Mukherjee (IAS:1991:UT), JS in PMO, appointed as Additional Secretary, Department of Water Resources, River Development and Ganga Rejuvenation.
  14. Ms Rachna Shah (IAS:1991:KL) appointed as Additional Secretary, Cabinet Secretariat vice Rajesh Bhushan (IAS:1987:BH) who was yesterday appointed Secretary (Coordination), Cabinet Secretariat.
  15. B Srinivas (IAS:1991:KL) appointed as MD, National Horticulture Board, Department of Agriculture in the rank and pay of Additional Secretary.
  16. Satya Brata Sahu (IAS:1991:OR) appointed as Additional Secretary, Department of Land Resources, Ministry of Rural Development. Presently he is Director (JS level), NHIDCL.
  17. Vijayendra (IAS:1991:AM) appointed as CMD (AS level), National Small Industries Corporation Ltd. Presently, he is JS, Department of Defence Production.

The ACC has also approved upgradation of the following officers of 1991 batch on in-situ basis to the level of Additional Secretary (GoI) as a measure personal to them, by temporarily upgrading the posts held by them:

  1. Kamran Rizvi (IAS:1991:UP), JS , Department of Rural Development as Additional Secretary, Department of Rural Development.
  2. G Asok Kumar (IAS:1991:TG), Mission Director, National Water Mission, Ministry of Jal Shakti in-stu elevated in the rank and pay of Additional Secretary.
  3. V Thiruppugazh (IAS:1991:GJ), Advisor, National Disaster Management Authority elevated (In-situ) in the rank and pay of Additional Secretary.
  4. Anil Malik (IAS:1991:HY), JS MHA as as Additional Secretary, Ministry of Home Affairs.
  5. Ms. Vandana Gurnani (IAS:1991:KN), Joint Secretary, Department of Health & Family Welfare as Additional Secretary, Department of Health & Family Welfare.
  6. Rajit Punhani (IAS:1991:BH), Chief Vigilance Officer, National Thermal Power Corporation Ltd in the rank & pay of Additional Secretary.
  7. Jan E Alam (IAS:1991:NL) Joint Secretary, Ministry of Minority Affairs, Ministry of Minority Affairs.

The posting of 1987 batch IAS officers as Secretary in Govt of India kick-started on Tuesday making 1991 batch IAS officers curious about their fate at Centre. 

If some top sources are to be believed the NaMo administration is ready with a fresh new list of appointments to the post of Additional Secretary and equivalent which may be announced by today evening or tomorrow.

It may be underlined that 31 IAS officers from 1991 batch were on October 09, 2019 empanelled  as Additional Secretary and Additional Secretary equivalent in Govt of India. In addition the list included a 1989 batch IAS officer as well.

Finally, 1987 and 1991 batch of IAS officers may start counting hours and days to get their turn to hold Secretary and Additional Secretary rank posts at Centre.

 

Indianmandarins has reliably learnt that NaMo administration may announce the empanelment either this week or by early next week. Reportedly, the process is complete and awaiting PM’s approval.

 

Power corridors are often abuzz of the AS empanelment of 1991 and 1992 batches together.  Contrary to the buzz 1992 batch of IAS may have to wait a little more. As many as 28 officers from 1991 may join the league for holding Additional Secretary (AS) rank posts whereas 09 may  be drafted into AS equivalent rank.

IAS officers empanelled to hold Secretary and Additional Secretary-level posts in the Govt of can't but feel disappointed because even eight months after their empanelment in July 2018, they are still waiting for their posting and elevation (in-situ) for pay-scale.

 

Initially, it was thought that the empanelment of 1984 and 1985 batch of IAS as Secretaries and of 1987 and 1988 batch of IAS officers as Additional Secretaries might streamline the administration by way of filling the critical gaps in the hierarchy, but the whole scheme has turned out to be a non-starter. In reality, a lot of complexities has arisen to streamline the postings of the batches involved. Probably this was the reason the 1986 batch of IAS was empanelled for Secretary-level posting alone; signalling the same approach towards the empanelment (alone) of 1991 batch.   

 

Further, except Rajni Sekhri Sibal (IAS:1986:HY), the entire batch of 1986 is still awaiting its turn for posting but there are no vacancies at Secretary-level posts in the GoI. Contrary to the convention, 1986 batch officers were not even accommodated as Special Secretaries (in-situ) in rank and pay-scale. Similarly, the 1990 batch of IAS officers has not got either the AS-level posting or the pay-scale.

 

Having experienced the futility of empanelment of two batches together, it is believed that even if the NaMo administration is voted to power again, it may avoid trying this method again. Probably, the decision-makers overlooked the hard fact that the administrative framework, whether at the Centre or the state, is configured to offer only a limited number of posts and the empanelment of two batches together falls out of sync and creates an increasingly complex situation to justify the posting and in-situ promotion at both levels.

 

Like the 1986 batch, the empanelment process of 1987 batch has kickstarted alone as the government is said to be keen on not repeating the earlier mistakes. Similarly, 1991 batch IAS officers may be empanelled alone, even though the 1989 and 1990 batches were empanelled together without yielding any benefits.
