New Delhi (18.03.2026): A major administrative row has surfaced within the National Company Law Tribunal (NCLT) as its senior-most Technical Member, Kaushalendra Kumar Singh (IRS-IT: 1986), has moved the Delhi High Court to challenge the appointment of an Acting President.

The legal challenge is directed against the government’s March 16 notification, which appointed Justice Bachu Venkat Balaram Das (Judicial Member) as the Acting President of the NCLT.

According to well-placed sources, K.K. Singh has contested the appointment on the grounds of seniority. Singh, a former Principal Chief Commissioner of Income Tax, joined the NCLT at its Ahmedabad Bench before being transferred to the Delhi Bench. He contends that his administrative and service seniority surpasses that of Justice Balaram Das, making the recent notification procedurally flawed.

This challenge could set a precedent for how "Inter-se Seniority" is calculated between Judicial and Technical members when it comes to officiating leadership roles within the tribunal.

NCLT operates through its 15 benches nationwide. The tribunal’s current strength consists of 30 Judicial Members and 30 Technical Members, balanced to handle complex corporate insolvency and liquidation cases.
