Justice Hemant Gupta from the Punjab & Haryana HC has been recommended as the acting chief justice of Patna HC. The other judges recommended for elevation as chief justices include Justice Dinesh Maheshwari from Allahabad HC to Meghalaya as its CJ; Justice D H Waghela, CJ, Orissa to Bombay as CJ; Justice Ajit Singh of Rajasthan HC to Gauhati as its CJ; Justice Vineet Saran from Karnataka to Rajasthan as its CJ; Justice S K Mittal from Punjab & Haryana HC as Rajasthan chief justice; Justice S K Mukherjee of Karnataka HC to be made CJ of the same HC and Justice R Subhash Reddy from AP/Telangana to Gujarat as its CJ. The CJs of Rajasthan, Karnataka and Gauhati had retired last year and of the Meghalaya high court retired on January 16. The four HCs are currently being looked after by acting chief justices. The SC collegium held its first meeting on January 12 after the NJAC was struck down. The collegium also recommended appointment of 17 additional judges as permanent judges of the HCs. There are at least 75 judges in various HCs who are presently working as additional judges appointed on a two-year contract. All these appointments which were due for review after completion of their tenure were stuck following the litigations involving the notification of the NJAC Act. Chief Justice of India T S Thakur has avoided making any new appointment of judges in the HCs till the memorandum of procedure (MoP), which will set guidelines for the collegium, is ready. The government is still in the process of consulting chief ministers and chief justices of HCs before making a final draft of the MoP which is to be finalised in consultation with the CJI.
