New Delhi (14.11.2024): The Supreme Court of India verdict to lay down the procedure of bulldozer action on illegal construction is being looked upon as castigation on the Uttar Pradesh government and the Centre allowed this to happen to put Yogi Adityanath in dock. But the way BJP spokespersons were defending Yogi, it did not appear that the Centre was in anyway against Yogi Model? The UP CM too made it clear that his government was neither a party in the case nor SC banned demolition drive as such against illegal encroachments. Welcoming the court decision, he said that UP followed every legal procedure before demolition. However, the court was very categorical that Executive cannot become a judge; demolishing home of accused without due process is unconstitutional; punishment cannot be razing properties of even convicted persons; no one can penalise the accused before trial; and Rule of Law compliance must even for municipal laws.
