The Delhi High Court has upheld
the Constitutional validity of Rule 135 of the Research and Analysis Wing
(Recruitment Cadre and Services) Rules, 1975, which gives power to the Central
government to voluntary retire RAW Officers whose identity is exposed or compromised. The judgment was pronounced by a
Division Bench of Justices S Ravindra Bhat and Sanjeev Sachdeva in a challenge
to the order of the Central Administrative Tribunal (CAT) setting aside the
government's order which had voluntarily retired RAW Officer Nisha P Bhatia as
per the said Rule.
