RERA: Jigsaw puzzle of appointments in Himachal

The entire bureaucracy in Himachal Pradesh has been anxiously watching the appointment of next Chairperson of RERA in the state. Himachal Pradesh RERA has advertised the position for appointment in a hush-hush manner giving just 20 days to apply for the post.

Immediately after the advertisement of the vacancy, the outgoing Chief Secretary Dr Srikant Baldi (IAS:1985:HP), retiring next month, gave up the charge of the housing department to ensure that there are no allegations of conflict of interest.

What brings insight into this prospect is the fact that just five months ahead of his retirement, Baldi was given charge of the Housing Department in August which he never handled before. If some top sources are to be believed, it is to make him eligible for the post of Chairman RERA since he has no experience of housing sector. Is the jigsaw puzzle of appointment in HP bureaucracy solved?

HP: Several top posts on hold, next RERA Chairperson remains a mystery

The entire bureaucracy in Himachal Pradesh is anxiously watching the appointment of next Chairperson of RERA in the state. So far, no retired bureaucrat has got any post-retirement assignment under the present govt. The State Govt scrapped the State Administrative Tribunal after recommending the names of Srikant Baldi and Manisha Nanda for appointment as Member, Administration.

Vacant posts in the HP Public Service Commission too have not been filled up as yet. The appointment to the post of Chairperson Himachal Pradesh Food Commission has reportedly been put on hold. For RERA, the outgoing Chief Secretary Dr Shrikant Baldi (IAS:1985:HP) is the front runner and he is reported to have identified office accommodation and staff as well whereas the post is yet to be advertised.

Govt of Odisha appointed Malay Chatterjee as Member-Technical/Administrative Member of Odisha Real Estate Appellate Tribunal (OREAT). Earlier Chatterjee worked as Chairman & Managing Director of Kudremukh Iron Ore Company Ltd (KIOCL). Further, Ishan Kumar Das was appointed Judicial Member of OREAT.

Home buyers oppose builders' move to dilute RERA

The Forum for People’s Collective Efforts (FPCE), a pan-India homebuyers’ association, has objected to realty developers’ proposal to amend the structural defect liability and workmanship clause under the Real Estate (Regulation & Development) Act, 2016.

 

At the first meeting of the committee formed last month under the chairmanship of Housing Ministry's additional secretary SD Meena to implement the provisions of the RERA, FPCE representatives pointed out that homebuyers received the invitation to attend the workshop at short notice and were not informed that the workshop’s objective was to get suggestions from them for amendment of the Act with regards to removal of difficulties.

 

FPCE representatives also opposed the proposals by developers to bar the jurisdiction of consumer forums. The referred to the minister for housing's statement that no provision of the Act will be amended.

Former UP Chief Secretary is Chairman, RERA

Former UP Chief Secretary Rajive Kumar (IAS:1981:UP) became the first full-time  Chairman of RERA whereas Balvender Kumar (IAS:1981:UP), former Union Mines Secretary and former Vice-Chairman DDA, was appointed Member.

 

In addition, Bhanu Pratap Singh (Retd IPS) and Kalpana Mishra were also made Member of RERA in UP.

 

Prior to this Principal Secretary (Housing) Nitin Ramesh Gokaran (IAS:1990:UP) held the additional charge of the post.


It may be underlined that Real Estate Regulatory Authority (RERA) is constituted under the The Real Estate (Regulation and Development) Act, 2016; an Act of the Parliament of India which seeks to protect home-buyers as well as help boost investments in the real estate industry.
