Sindhuri wins again; HC stays CAT's order on her transfer

sindhuri-wins-again-hc-stays-cats-order-on-her-transferThe Karnataka High Court has stayed the Central Administrative Tribunal (CAT) verdict, which had upheld the State government's order of transferring IAS officer Rohini Sindhuri Dasari from the post of Hassan Deputy Commissioner. It has also set aside the IAS (Cadre) Amendment Rules 2014, which stipulates the minimum tenure for cadre posts and constituting civil services board to recommend the transfer of IAS officers. A Division Bench, comprising Justice H.G. Ramesh and Justice B. Sreenivasa Gowda, passed the interim order on Friday on the petition filed by Ms. Sindhuri, who had questioned the April 17 verdict of the Tribunal. In her petition, she said that the CAT, without examining the question of validity of the March 7, 2018 Government Order of "prematurely" transferring her from the post of Hassan DC, virtually wrote "a thesis and not a judgment" with sweeping directions "sitting in judgement over the judgment of the Supreme Court and also badly commenting on the wisdom of the Supreme Court".
