Justice Gogoi may be the next CJI

justice-gogoi-may-be-the-next-cjiClose to the completion of tenure of Chief Justice of India Justice Dipak Misra, the speculations have started doing rounds that the Union Government is considering Justice Ranjan Gogoi's name for the next CJI. Questions over Justice Gogoi's appointment started doing the rounds following the unprecedented press conference held in January this year by four of the senior-most judges wherein sitting CJI was criticised over administrative issues, especially allocation of cases to select benches. Justices J Chelameswar, Ranjan Gogoi, Madan B Lokur and Kurian Joseph had addressed the press conference, the likes of which was never seen in the judicial history of India. The Union Law Minister Ravi Shankar Prasad has made Govt's intention clear saying that there was no reason for being sceptical but the convention required that the sitting CJI first send the name of his successor. As per the memorandum of procedure, "Appointment to the office of the Chief Justice of India should be of the senior-most judge of the Supreme Court considered fit to hold the office." In past, there has been only one instance of supersession. During the Emergency era, the Indira Gandhi govt appointed Justice A N Ray as the CJI, superseding three senior judges of the Supreme Court namely; J M Shelat, A N Grover and K S Hegde. Post Union Law Minister's statement it is believed that prospects for Justice Gogoi to become successor to Justice Deepak Misra remains fair.
