The Central Bureau of Investigation has registered a case U/s 120B of IPC and Section 7 & 13(2) r/w 13(1) (a) & (d) of P.C. Act, 1988 against a number of West Bengal Members of Parliament, Members of Legislative Assembly/Ministers, previous MP/MLA and a police officer of West Bengal on the conclusion of a preliminary inquiry initiated by it on a Calcutta High Court order.
The High Court had directed the bureau to conduct a preliminary iInquiry and conclude it within 72 hours, after taking over the custody of the devices of Sting Operation and CFSL Reports from the Committee constituted by the High Court. The High Court also directed CBI to ascertain whether the Respondent of in WP No. 5243 (W) of 2016 had indulged in corrupt practices in the video footages of the sting operation and further mentioned in its order that depending upon the result of the enquiry, CBI shall forthwith register an FIR in respect of the alleged crimes and proceed to investigate the same in accordance with law.
The respondents challenged the aforesaid order of the High Court by filing an SLP, but vide order dated 21.3.2017 in SLP(Crl) No.2259 and 2261 of 2017, the Supreme Court upheld the directions of High Court, Calcutta for Preliminary Enquiry by CBI into the allegations of the aforesaid PILs. However, the Supreme Court relaxed the timeline for the conclusion of the inquiry by granting CBI time of one month from the date of passing of the order by the High Court.
CBI conducted the Preliminary Enquiry into the said allegations expeditiously. Inquiry revealed prima facie material for registration of a Regular Case(FIR) under appropriate sections of Prevention of Corruption Act, 1988 and IPC. Further investigation is continuing.
